http://negotiationsimulation.wordpress.com/

Collective Bargaining Assignment (25%)

Background:

Collective bargaining is a key activity in industrial and labour relations.  Our outlined in your textbook and discussed in class, it is the regular negotiation process that takes place between the union and management bargaining teams to determine the terms and conditions of the Collective Agreement.  This Collective Agreement then sets the rules for the workplace until the next bargaining round.

The best way to learn about collective bargaining is to do it! But this is more challenging in a virtual environment with people across time zones. So, we are doing a modified simulation.

You will work with a partner to prepare one bargaining proposal from the perspective of either the management bargaining team OR the union bargaining team. I will randomly assign you to either the management or union perspective.

We will be using source material from a collective bargaining simulation designed by Dr. Kelly Williams-Whitt of the University of Lethbridge, AB.  The simulation is called Mason’s Cottage and can be found at:

http://negotiationsimulation.wordpress.com/

This site contains information that is critical to your preparation for and success in bargaining.  Some information is password restricted and is typically only shared with the union or management side. I will give you the passwords in class.

You will specifically want to consult the following material for this assignment:

On the Union Website: https://unitedfoodworkers.wordpress.com/

  • Collective Agreement
  • Internal Memo – Membership Survey (password required)

On the Mason’s Cottage website: https://masonscottage.wordpress.com/industry-background/

  • About Mason’s Cottage
  • Corporate History
  • Financial Information
    • Income Statement
    • Wages and Benefits
  • Industry Background
  • Internal Memo (password required)
  • Labour Market Analysis

Assignment Details:

  1. You will be preparing a new bargaining proposal for Article XXII – WELFARE
    • The union groups will be seeking to expand the benefits program
    • The management groups will be seeking to reduce benefits costs

  1. For your proposal you will include the following on 1-3 pages depending on the space required for your economic costing (see Appendix 1 for a sample template):

  • Three versions of your new proposal language written as it would appear in the Collective Agreement and ‘marked up’ using the format that we will discuss in class.
    • Opening offer
    • Target offer
    • Resistance point

  • Your assessment of how important getting this proposal is to your stakeholders (either the union membership or the CEOs of Mason’s Cottage, as applicable) and evidence for that conclusion
  • Accurate costing of the economic implications of the change you desire for each version of your proposals (show me your work)
  • The argument that you would make to convince the other party to agree to your change (i.e., the speaking notes of the Chief Negotiator)
  • Identification of any opposing arguments and strategies for addressing them

  1. Submit your assignment on OWL

Appendix 1: Sample Template for Proposals

Clause Number and Name

Opening Proposal: (write out full proposal as you would to exchange with the other side on the first day of bargaining)

Target Language: (write out full clause in proper language)

Resistance Proposal: (write out full clause in proper language)

Issue ranking and explanation of that ranking:

Economic Costing: (as applicable, show the steps of all math, do not just insert a completed spreadsheet.  Provide costing for a range of proposals – i.e., for your opening, target and resistance positions)

Your Argument: write out how you will convince the other side of the merits of your proposal

Counter-Argument: write out any counter-arguments that you anticipate that the other side might raise and include your solutions for addressing those arguments
